Thief charged

THE OFFICE of the City Prosecutor found probable cause to indict a man who was caught in the act of stealing a wallet last May 1.

Prosecutor Irene Joy Tala-Montero has charged Oliver dela Torre for theft under Article 308 in relation to Article 309 paragraph 3 of the Revised Penal Code based on the complainant filed by Lorventh Sweet Alegata.

Based on the report, a concerned citizen saw the respondent took a wallet placed inside the backpack of the victim. The wallet contained P700.

The witness then informed the victim.

The suspect escaped but was cornered by responding concerned citizens. The wallet was recovered for the suspect’s possession.

Montero, in her May 10 resolution approved by prosecutor Maria Gemma Dabbay-Tambis, said dela Torre is liable to the complaint filed against him.

“Considering that the stolen items were found in the possession of the respondent, the inescapable conclusion is that he was the perpetrator of the crime,” the resolution read adding that “a person found in possession of a stolen thing is presumed to be the taker thereof and the author of the theft, in the absence of satisfactory explanation of his possession.”
