Suspect charged with molesting 8-year-old

THE OFFICE of the City Prosecutor has indicted a man for allegedly harassing his 8-year-old relative on Oct. 6.

The respondent, name withheld to protect the victim, is indicted for acts of lasciviousness under Article 366 of the Revised Penal Code in relation to Sec. 5(b) Art. III of Republic Act No. 7610 (Child Abuse).

The respondent was arrested on Oct. 7 after the complainant-minor told the authorities that her private parts were being touched by the respondent.

In indicting the respondent, prosecutor Jay Karel Sanchez II, claimed that the elements of sexual abuse under Sec. 5, Article III of R.A. 7610 are as follows, first the accused commits the act of sexual intercourse or lascivious conduct. Second, the said act is performed with a child exploited in prostitution or subjected to other sexual abuse. Third and last, the child, whether male or female, is below 18 years of age.

“In this particular case, the act was committed on a minor child eight years of age and was committed through influence, when the respondent, taking advantage of the credulity of the minor and considering the fact that he is a relative and neighbor of the complainant, caused the latter inability to put up any resistance,” the resolution read.

Meanwhile, the complainant-minor also told the authorities that she was also sexually abused by the respondent last Oct. 2.

The respondent was given a period 10 days from receipt of this Resolution to file his counter-affidavit.
