Prosecutor charges man for slay try  

A DRUNK man who allegedly attacked another at Purok 21, Salam village, Barangay Sto. Niño in Tugbok District was charged with attempted murder by the Office of the City Prosecutor

Prosecutor Maria Cynthia Prat on Feb. 14 recommended the filing of information against Romero B. Pagara under Article 248 in relation to Article 6 of the Revised Penal Code based on the complaint filed by John Carlo Agdon.

Prat said that treachery was present in the commission of the crime.

“The respondent suddenly stabbed the victim who was smoking a cigarette. Obviously, in that position, the victim was not in a position to defend himself,” the resolution read. “The victim has no inkling of what the respondent was about to do when the respondent suddenly appeared. A sudden attack an unarmed victim constitutes treachery.”

Based on the police report, Pagara was drunk when he stabbed Agdon several times on the left abdomen, left arm, left palm and left cheeks. The victim as brought to the Southern Philippines Medical Center.

Pagara was later arrested by the police in a follow-up operation.
