Ordinance requiring buildings to adopt green tech approved

THE SANGGUNIANG Panlungsod has unanimously approved an ordinance that will require future buildings to adopt green technology.The Green Building Ordinance 2018 of Davao City requires future buildings to adopt measures on energy efficiency, water efficiency, materials and waste management, site sustainability, and indoor environmental quality.

Councilor Diosdado Mahipus, chair on the committee on energy, said they want to ensure the environmental sustainability of buildings and reduce the negative impact to health and environment.
Covered in this proposed ordinance are:
 Condominiums with total floor area bigger than 20,000 square meters
 Office buildings with total floor area bigger than 10,000 square meters
 Educational buildings with total floor area bigger than 5,000 square meters
 Retail buildings with total floor area bigger than 15,000 square meters,
Also included are hotel buildings, hospital buildings, and government offices.
Sec. 11 (Green Building Certificate) states that all owners and developers of projects within the coverage of the ordinance shall secure a Green Building Pre-Compliance Certificate (GBPCC) in building design, and Green Building Compliance Certificate (GBCC) in construction.
Sec. 15 provides for filing fee of P150 for green building pre-compliance certificate, and P50 green building compliance certificate.
A surcharge of 100% of the total green building fees but not be less than P2,000, whichever is higher, shall be charged to any applicant, proponent, proprietor, owner or representative who undertakes any project without having first secured the Green Building Pre-Compliance Certificate.
Violators of the ordinance will be penalized between P500 and P5,000 or imprisonment of two months to one year, or both at the discretion of the court.
The Davao City Green Building Council (DCGBC) will also be established to enforce the ordinance.
However, during the Feb. 20 session Councilor Bonifacio Militar proposed that a separate ordinance creating the DCGBC will be passed by the Sangguniang Panlungsod upon the discretion of the mayor.
The proposed ordinance was passed on second reading on Feb. 20 while passed on first reading last Oct. 10, 2017.
