Man faces murder try after stabbing neighbor  

A MAN is facing trial after he allegedly tried to kill another in Purok 4, Barangay Tamayong, Calinan District on Nov. 20.

Prosecutor Faizal Padate, in his resolution dated Nov. 28, charged Boyet Sadani Mendan for frustrated murder under Art. 248 in relation to Art. 6 of the Revised Penal Code.

The case stemmed from the complaint filed by Jimmy Asham Dalon. Mendan was initially sued by Dalon for serious physical injury.

Padate found probable cause to indict Mendan for frustrated murder as “intent to kill is manifested by the weapon used by the respondent, a knife, and the injury of complainant which is on his chest.”

He added that the injury sustained by complainant appeared to be fatal considering that during the inquest, complainant was still confined at the hospital.

The prosecutor also said that treachery was present in the commission of the crime because it was sudden and unexpected without giving the complainant the opportunity to defend himself.

Based on the police report, Dalon was drinking with his friends when Mendan arrived and joined them. But after a few minutes Mendan suddenly stabbed Dalon without any provocation.

After the attack, Dalon was rushed to Southern Philippines Medical Center while Medan escaped but was arrested by a concerned citizen and later brought to Calinan Police Precinct.
