Man charged for weed possession

THE OFFICE of the City Prosecutor found probable cause to charge a man following his arrest last Aug. 19 for allegedly carrying illegal drugs.

Prosecutor Irene Joy Tala-Montero recommended for the filing of violation of Sections 11 and 12 in relation to Sec. 25 of RA 9165 (Comprehensive Dangerous Drugs Act of 2002) against Amer Candao Avido.

Around 7:30 a.m. of Aug.19, while a police officer was rendering duty at the vicinity of Roxas avenue, he saw Avido holding a black sling bag heading to his location. The policeman approached the respondent to inspect the bag as part of the security measure.

Upon seeing the police officer, Avido allegedly ran away which forced the police officer to give chase. He was cornered with the help of the other policemen.

Upon checking the black sling bag, the police officer recovered four self-sealing plastic sachets containing suspected dried marijuana leaves with fruiting tops, one piece black improvised wood pipe, one rolled cigarette paper used as improvised tooter, and one rectangular shape plastic adhesive cellophane containing several self-sealing transparent sachets placed inside a color blue pouch inside the bag.

He was then arrested and was brought to the Sta. Ana Police Precinct. The suspect also tested positive for THC-metabolites, a byproduct of marijuana.

“The conduct of the said test is justified considering that during the arrest of respondent, the complainant avers that respondent appeared to had reddish eyes, uneasy and pale which are manifestations of a person who is under the influence of illegal drugs,” the resolution stated.
