Man carrying unlicensed modified firearm charged

A MAN is facing trial for allegedly carrying a firearm without license on April 28 in Toril District.

Albert Capul was charged for violation of Sec. 28 (e) (1) of the Republic Act 10591 (Comprehensive Firearms and Ammunition Regulation Act).

Prosecutor Irene Joy Tala-Montero, in her May 10 resolution approved by Prosecutor Shahruddin Roberto Sencio, recommended the filing of Capul’s information in court as she found probable cause to indict the respondent based on the evidence presented against him.

Montero also noted that the arrest was valid even without warrant of arrest under the Sec. 5(a) Rule 113 of the Revised Rules of Criminal Procedure.

The record showed that Capul was arrested by PO1 Johvanne Bacorta for carrying an improvised gun known as sumpak, and loaded with a 9mm ammunition.

Reportedly, the suspect was drunk and challenging a person in the street to a fight while brandishing his gun. The police tried to persuade him into surrendering his gun but he refused, so they were forced to disarm and subdue him.
