LTO chief’s driver charged for fixing

AN EMPLOYEE of the Land Transportation Office (LTO), assigned as driver of the regional director, will be facing court trial for alleged fixing.

 Prosecutor Maria Gemma Dabbay-Tambis charged

Namerto Advincula Tumbag Jr., for violation of Republic Act 9485 (Anti-Red Tape Act of 2007).

 Tumbag is said to be the driver of LTO Director Atty. Gomer Dy.

 Investigating Prosecutor Sharhruddin Roberto Sencio Jr., found probable cause against the respondent based on the complaint filed by National Bureau of Investigation (NBI).

 Sencio said Tumbag was “caught in flagrante delicto facilitating the speedy completion of the release of the driver’s license of Jayson Canonia Canaya from the Land Transportation Office with which he is employed for the amount of P4,000 with P844 of which is his pecuniary gain.”

 The respondent was arrested in an entrapment operation inside the LTO office on June 30 after the NBI received reports on his alleged illegal activities.

 Sencio said the arrest of Tumbag was valid.

 During the inquest proceeding, Tumbag was referred to the Public Attorney’s Office for the possible exercise of his right to preliminary investigation but he said that he will just face the charge in court.

The prosecutor cited that fixer refers to any individual whether or not officially involved in the operation of a government office or agency who has access to people working therein, and whether or not in collusion with them, facilitates speedy completion of transactions for pecuniary gain or any other advantage or consideration.

 The crime carries a penalty of imprisonment not exceeding six years or a fine not less than P20,000 but not more than P200,000 or both fine and imprisonment at the discretion of the court.

 Tumag was earlier pointed to have been asking money from the operators of public utility vans to facilitate the release of their registration. He was also accused of allegedly asking fees from the operators of colorum passenger vehicles.

 Director Dy earlier denied knowing the illegal activity of his driver.
