Judges ready commitment order for Maute patriarch, three others

THE REGIONAL Trial Court (RTC) and Municipal Trial Court in Cities (MTCC) judges handling the case of the Maute patriarch and his companions have already prepared their respective commitment orders.

However, RTC Branch 10 Retrina Espe-Fuentes and MTCC Branch 6 Judge Nanette Gustillo Lemana are still waiting for Cayamora M. Maute, Benzar Ali Iman Tinago, Norjannah Maute Tinago and Kongan Alfonso Balawag to be presented to their salas.

Fuentes is handling the case of Maute for violation of Sec. 28 E (1) in relation to Sec. (a) of Republic Act 10591 (Comprehensive Firearms and Ammunition Regulation Act) and violation for Sec. 3 of Presidential Decree 1866 as mended by Republic Act 9516 (Law on Explosives). The others were also indicted as accomplices for the same offense.

While Lemana is handling the Sec. 1 (c) Presidential Decree 1829 (Obstruction of Justice) charge of Benzar Tinago, Norjannah Tinago and Balawag for harboring Maute.

However, Maute and three others were flown to Manila at 9:45 p.m. Wednesday after 24-hour detention at the Davao City Police Office for security reasons. AFP spokesperson Brig. Gen. Restituto Padilla has confirmed in a Manila Times report on Thursday that the four suspects are already committed in Camp Bagong Diwa, Taguig.

The TIMES tried to contact City Prosecutor Nestor Ledesma to ask if there is a petition to transfer the venue of their case. But Ledesma have not responded as of the press time.

The respondents were arrested at a checkpoint at Barangay Sirawan, Toril while on board a Toyota Grandia van, which was stopped by authorities manning the area. Recovered from them were a .45 caliber with magazine loaded with six bullets, cash and an M67 fragmentation grenade.
