Granddad who punched 10-year-old boy charged

THE OFFICE of the City Prosecutor has indicted a 77-year-old grandfather for allegedly mauling his 10-year-old boy last July 20.

Prosecutor Sharhuddin Roberto Sencio Jr. has charged Juanito Bejanting for violation of Sec. 10 of Republic Act 7610 (Child Abuse).

Based on the affidavit of the complainant, he claimed that he was playing with his cousins when another child Miguel arrived and teased them. In response, the complainant kicked Miguel three times who then went home crying.

The complainant went back to playing with his friends when the respondent arrived and punched him several times.

During the inquest proceeding, the respondent opted not to exercise his right to preliminary investigation and face the charge in court. Thus his case was resolved based on the allegations and evidence filed against him.

In determining the probable cause, Prosecutor Grace Lydda-Lariego said there is no reason to believe the statement of the child as the medical certificate showed that the boy sustained a contusion not only on his face but on his abdomen and back areas.

Lariego added that the respondent should have reprimanded the complainant instead of hurting him.

“While respondent as the child’s grandfather may have felt justified in hurting the child since it was after all the complainant who set into motion the succeeding events after he repeatedly hit Miguel but a reprimand would have sufficed under circumstance,” the resolution.

Lariego added that the repeated punches to the child constitute cruelty which is penalized under Sec. 10 of RA 7610. The prosecutor also noted that the arrest of the respondent is lawful under Section 6 of Rule 113 of the Revised Rules of Criminal Procedure.
