DepEd IX director sentenced to 2-10 years in jail for graft

THE SANDIGANBAYAN has sentenced the former regional director of the Department of Education IX in Pagadian City from two to 10 years jail term after finding him guilty of graft.

In a 26-page decision promulgated on Nov. 17, the anti-graft court’s First Division found Jesus Nieves “guilty beyond reasonable doubt” of violation of Republic Act No. 3019 (Anti-Graft and Corrupt Practices Act) and for falsification of public documents under Art. 171 of the Revised Penal Code.

Nieves also face perpetual disqualification from holding public office for violating RA 3019, and ordered to pay a fine of P2,000 for falsification of public documents.

The case stemmed from the anomalous disbursement of P4,776,786 in Priority Development Assistance Fund (PDAF) which was allotted to the DepEd Region IX.

Based on the records, the P4,776,786 was part of the total amount of P99,579,141 which the accused, as then regional director of DepEd Region IX, approved for payment regarding the transactions reflected in the list of due and demandable accounts payable to external creditors (LDDAP-EC).

On the other hand, Nieves, along with Marilou Tolosa, former official of DepEd IX, was indicted after the Ombudsman found probable cause to indict them for the missing P6 million fund in 2007.
