Barangay head of Gatungan charged for unlicensed gun

A BARANGAY captain in the second district will be facing trial after the Office of the City Prosecutor has indicted him for possessing unlicensed firearm.

Investigating Prosecutor Faizal Padate has charged Barangay Captain Herky Abad of Barangay Gatungan, Bunawan District for violation Republic Act 10591 (Comprehensive Firearms and Ammunition Regulation Act).

Padate, in his March 13 resolution approved by prosecutor Shahruddin Roberto Sencio Jr., found probable cause to indict Abad for possessing a firearm without legal documents.

Last March 5, agents of the National Bureau of Investigation – South Eastern Mindanao Regional Office (NBI-SEMRO) implemented a search warrant issued by Judge Emmanuel Carpio of Regional Trial Court Branch 16 against the respondent who is residing at Purok 1 in Barangay Gatungan.

During the implementation of the warrant, Abad surrendered a .45 caliber pistol, bearing a serial number 961432, with a magazine loaded with seven bullets.

Abad failed to show document to prove that he is authorized to possess the said firearm.

In the inquest proceeding, Abad did not exercise his right for preliminary investigation. As a result, his case was resolved based on the evidence presented.

Padate ruled that the arrest of Abad was valid as he was arrested by the officers while committing the crime.
