2 charged for raping girl, 12

GOVERNMENT prosecutors have indicted two men, including a minor, for allegedly raping a 12-year-old girl in Barangay Ubalde, Agdao District last All Saint’s Day.

 Senior Assistant City Prosecutor Shahruddin Roberto Sencio Jr. approved the filing of three rape charges against a 16-year-old respondent and two other rape cases against his adult cohort identified as Jessie Mahinay Calbonero Jr., both of Ubalde.

 Investigating prosecutor Jordana Day Villamor-Sarong found probable cause to indict the respondents sexually molesting the 12-year-old victim by force.

 “It bears to emphasize that the respondents committed the felony by force because of the following averments unequivocally stated in the complaint, that is: first, the respondents held and forced her to go with them to have a drink; second, when complainant was totally intoxicated, she was sexually molested separately by the respondents; and third, the complainant attempted to resist each time but because of the respondents’ employment of force, she was overpowered,” Sarong said in her resolution.

 Sarong also said the credibility of the complainant’s statement is fundamental in determining the probable cause because in rape cases the respondents maybe prosecuted based solely on the statement of the complainant.

 In this case, the prosecutor said the complainant’s statement is credible as she positively identified the respondents as the persons who sexually abused her.

 Her narration was also supported by the medical findings, which states that she was sexually molested.

 The prosecutor also noted that the arrest of the respondents was valid considering the immediacy between the commission of the crime and their arrest.
